Using Right to Information as a weapon
To strengthen the anti tobacco advocacy at the state level RTI has been used rampantly. The volunteers, students, Media and civil society organizations have applied under RTI several questions relating to tobacco issues. An orientation programme on use of RTI was organized in the tobacco resource center to make the students and youths aware on its various procedures for obtaining information.
Questions were asked to Education Department regarding action taken to implement Cigarette & Other Tobacco Products Act 2003 in the educational institutions . As a response to the query we received copy of the state governments circular to the department to implement the Act in educational institute informing about the law and for strict implementation of the Act.
Answering to the questions asked from different section of the community the Finance Department informed that there was no revenue from Tobacco products to the state.All these revenue were going into the Central Excise.After implementation of VAT in the year 2007-2008 there is revenue from Tobacco products by the state government which is amounting 32.30 crore.
When we asked information regarding communication from and to the central Government regarding notification and setting up of tobacco control cell,number of deaths due to tobacco consumption etc we received only copy of the central Act of COTPA.After examination of old records we came to know status of the notification .We collected copy of correspondence from government of India regarding setting up of Tobacco control cell.
